Terms and conditions

In short, chapter by chapter: how booking works, what you pay, how you cancel and what you need to have with you when you pick up the car.

1. Who we are and what we do

inchirieri.ro is operated by UNIRENT SOFTWARE S.R.L. (VAT ID RO37446534, Trade Register No. J23/964/2020, registered office in Otopeni, Ilfov, Drumul Gării Odăi 2-4-6, Romania). We are a car rental broker (intermediary): we provide a platform where you search, compare and book cars from several rental companies.

  • The Service Provider is the rental company that actually hands you the car. Its name and tax details are shown in the Order Note.
  • The Order Note is the document we send you with all the details of your request: car, dates, times, amounts, eligibility conditions.
  • The Rental Agreement is signed by you directly with the Provider, when you pick up the car. We are not a party to that agreement.

The Provider is responsible for allocating a car in the correct class, for delivery, for collecting the rent and the deposit, and for the technical and visual condition of the car. (Preamble, Definitions, Art. 1, 5)

2. How a booking works

  1. You tell us where, when and what you need (including age, how long you have held your licence, additional drivers, leaving the country, child seat, return in another city).
  2. You receive an offer with the available classes, rates, deposits and the cost of the protection products. The offer is valid only if confirmed on the spot, because prices and availability can change quickly.
  3. Once you choose, we issue the Order Note. Please note: the Order Note is not a confirmation.
  4. You check the details and confirm (usually by paying the advance).
  5. You receive the CONFIRMATION message, with the booking reference (a code in the format LLLCCCCCLL) and the Provider's phone number. Only now is the booking registered.

Checking the details is your responsibility. Read the Order Note carefully (dates, times, cities, amounts, options) and tell us before confirming if anything is wrong. We are not liable for bookings you confirmed with wrong details, and an accessory or option missing from the Order Note will not be provided. We recommend calling the Provider about a week before pick-up, to make sure the booking is registered correctly. (Art. 4, 7, 11, 12, 25)

3. Car class and “or similar”

The booking is confirmed for a car class, not for a specific model. We do not guarantee the make, model, engine or colour, and the photos are for guidance only.

  • Compare offers by class, price, deposit and the cost of protection, not by make. Assume you will get the smallest car in the class you chose.
  • The preference for a manual or automatic gearbox is respected in over 90% of cases. The age of the car is not guaranteed.
  • If no cars are available in the booked class, the Provider looks for one in a similar or higher class, at no extra cost. If only a lower class can be offered and you accept it, you pay only the price of that class.
  • In the very rare case that no car at all is available on the spot, we refund your advance; this is our only obligation to you.

4. Prices, payment and exchange rate

  • Rates are expressed in euro and include VAT, third-party liability insurance (RCA) and the road tax vignette.
  • Payment is made by card, in Romanian lei, when you pick up the car, directly to the Provider. Most providers use the UniCredit Bank cash-desk selling rate + 1% on the day of payment; some providers use + 4%.
  • If your card is in a currency other than the leu, your bank may charge conversion fees.
  • If you pick up the car later or return it earlier, you get no money back for the unused time.
  • Do you see a different price at the desk than in the Order Note? Call us on +40 750 111 000 before you accept the new rate and before you sign the agreement. After signing or paying, we can no longer intervene.
  • Obvious price errors (for example rates under 10 € per day) are not binding on us; such a booking may be cancelled.

5. The service fee (advance)

In most cases, the booking is confirmed by paying an advance, also called the service fee. It is the price of our search, comparison, advice and booking service, it is paid at the time of booking and it appears in the Order Note. Its amount differs from one offer to another, and in some cases it is not charged at all. Legally, the advance is a confirmatory earnest (art. 1544 of the Romanian Civil Code). (Art. 13, 14.1)

6. Cancelling the booking

The cancellation policy is simple and applies to both sides:

  • You cancel or do not show up on the agreed date, at the agreed time and place: you lose only the advance. We do not charge you the value of the whole booking, whatever the reason or the moment. If the reason can be proven (cancelled flight ticket, medical documents), we may keep the advance as credit for another order, for 3 years.
  • We cancel: we refund twice the advance you paid.
  • The Provider cancels or does not make the car available: we refund the advance in full, within 3 working days at most. Other compensation can be claimed only from the Provider.
  • You paid no advance: cancelling costs nothing, for either side.

Car rentals with a fixed date of performance are exempt by law from the 14-day right of withdrawal (art. 16 letter l of Government Emergency Ordinance 34/2014). (Art. 14, 21, 30)

7. The deposit and the protection products

  • The deposit is an amount separate from the rent, pre-authorised on your card when you pick up the car.
  • The protection product (SCDW, “full protection”) is a fee paid to the Provider, which reduces the deposit to zero or to a lower amount, for the whole period in the Order Note. For some cars it does not exist, for others it is mandatory. If you extend the rental, it is paid again for the added days.
  • Releasing the deposit is done by the Provider, usually within 30 days at most from signing the return sheet, if you hand the car back clean, undamaged, with the same fuel level and with all documents and accessories. Discussions about the deposit take place directly with the Provider.

Protection does not cover everything. Regardless of the deposit or the protection paid, you are fully liable for, among others:

  • breaching the rental agreement, driving under the influence of alcohol or prohibited substances;
  • damage not reported immediately to the Provider (and to the Police, where applicable), intentional damage or damage caused by negligence;
  • letting a person who is not named in the agreement drive the car;
  • missing fuel, wrong fuel, lost keys, documents or accessories;
  • a dirty or damaged interior, smoking in the car;
  • damage under the car, to the rims or to the tyres that does not come from an accident with another vehicle.

The list differs from one provider to another; read the agreement before you sign. (Art. 8, 9, 10)

8. Picking up the car: documents, card, age

You come in person, at the time in the confirmation (there is no grace period), with the original, physical documents:

  • a valid driving licence, held for at least one year (or longer, depending on the provider), plus an international driving permit when the law requires it;
  • a valid identity card or passport;
  • a Visa or Mastercard bank card with the main driver's name printed on it, with enough funds for the rent and the deposit. Cards without a name and fintech cards (for example Revolut, Monese) are not accepted.

The same requirements apply to additional drivers, who must be present at signing. The age limits and the minimum licence-holding period are those in the Order Note.

Before you sign, inspect the car: photograph any scratch or defect, check the fuel level and make sure all your observations are written in the handover report. Damage not recorded at pick-up may be charged to you.

The Provider may refuse to hand over the car if you are late, if you do not have the required documents or card, if you do not meet the eligibility conditions or if fraud is suspected. If you are refused the rental, call us immediately, from the desk. (Art. 6, 16, 26, 29)

9. Extra costs, extensions and delays

  • Paid separately and to be announced when booking: a driver who is too young or too old, additional drivers, return in another location, leaving the country, child seats, GPS and other accessories. Accessories depend on availability at the location.
  • An extension is not a guaranteed right: you ask for it at least 24 hours before the end of the booking, the Provider may refuse it, and the rate may be different. Keeping the car after the agreement expires, without the Provider's consent, brings penalties and may be a criminal offence.
  • Delays: if you are late, even slightly, let the Provider know. If you do not show up on the date and at the time booked, the booking is cancelled automatically.
  • Leaving the country and returning the car in another location are allowed only if agreed with the Provider beforehand.

10. Accidents, damage and problems along the way

  • Contact the Provider immediately, at the number in the confirmation, for any accident, breakdown or damage, however small.
  • Do not authorise any repair without the Provider's consent.
  • Report the event to the Police when applicable and keep all documents (statements, reports, photographs). Without these steps, the protection you paid for does not apply and you are fully liable.
  • Problems related to the rental itself (refusal of delivery, withholding of the deposit, charging of damage) are discussed with the Provider you signed the agreement with. We can help you communicate with them, without taking over their liability.

11. Our liability

  • Our obligation is one of intermediation: we pass your booking to the Provider correctly and completely and, on request, give you proof of this.
  • We are not liable for how the Provider performs its agreement (availability, condition or safety of the car, services at the desk) or for the damage you cause to the rented car.
  • Our liability to you is limited to the amounts in the cancellation policy (refund of the advance, or twice the advance), except for damage caused intentionally or through gross negligence.
  • We do not cover indirect costs: hotel, other rented cars, taxi, lost time or opportunities.
  • Information about rates and availability comes from the providers; we cannot guarantee its accuracy in real time.
  • If a court declares a clause void, the others remain valid.

12. Code of conduct

We ask you to treat our staff and the providers' staff with respect and to obey the law, especially the Road Traffic Code. We reserve the right to refuse or cancel a booking, at any stage, in case of aggressive language or behaviour, threats, suspicious documents or suspected fraud. On request, you help us with the mandatory know-your-customer and anti-money-laundering checks.

We constantly monitor the quality of the providers' services and we may ask you how the rental went. (Art. 16, 17, 18)

13. Digital agreements and your data

Some providers draw up the agreement digitally, on a tablet. You can ask for a printed copy at signing or ask us for the digital copy; we send it within 24 hours at most.

We pass your e-mail address to the provider only for traffic fines or in specific situations that require it (for example data protection notices, such as a security breach); we nevertheless reserve the right to pass it on whenever we consider it necessary. 14. The service providers

We work with, among others, Autonom, Travis, Bavaria, Cronoscar, Axis / Autoklass, Expedicar, AMA, Hermin, IMAG, Klasswagen, Pricecarz, Payless, Trio, Zoe Auto Rent, Carhunt, Drivesmart, Procars, WLC and Hippo. The provider of your booking is the one named in the Order Note.
